Causal processes can give rise to distinctive distributions in the linguistic variables that they affect. Consequently, a secure understanding of a variable's distribution can hold a key to understanding the forces that have causally shaped it. A storied distribution in linguistics has been Zipf's law, a kind of power law. In the wake of a major debate in the sciences around power-law hypotheses and the unreliability of earlier methods of evaluating them, here we re-evaluate the distributions claimed to characterize phoneme (...) frequencies. We infer the fit of power laws and three alternative distributions to 166 Australian languages, using a maximum likelihood framework. We find evidence supporting earlier results, but also nuancing them and increasing our understanding of them. Most notably, phonemic inventories appear to have a Zipfian-like frequency structure among their most-frequent members (though perhaps also a lognormal structure) but a geometric (or exponential) structure among the least-frequent. We compare these new insights the kinds of causal processes that affect the evolution of phonemic inventories over time, and identify a potential account for why, despite there being an important role for phonetic substance in phonemic change, we could still expect inventories with highly diverse phonetic content to share similar distributions of phoneme frequencies. The impetus for the (...) project was embryo-splitting research conducted by Drs. Jerry L. Hall, Robert J. Stillman, and others, at George Washington University and presented in October 1993 at a joint meeting of the American Fertility Society and the Canadian Fertility and Andrology Society. Media coverage at the time reported that the research had been approved by the university's formal review committees. However, it came to light in December 1994 that the researchers had not obtained approval from the university's institutional review board prior to conducting the research. Following a university investigation, the researchers were disciplined and instructed to destroy their data. The university also voluntarily forwarded the records of the incident to the Office for Protection from Research Risks at the National Institutes of Health. Dr. Hall resigned from George Washington University in September 1994.In the following postscript to her article on the ethics of embryo splitting (KIEJ, September 1994), Ruth Macklin discusses these events. The letters and memoranda that she cites were obtained from NIH through the Freedom of Information Act.My article, "Splitting Embryos on the Slippery Slope: Ethics and Public Policy" (KIEJ, September 1994), included a brief assessment of the ethics of the Hall-Stillman embryo-splitting experiment conducted at George Washington University (GWU). The article reviewed the researchers' stated purpose ("to help infertile couples by reproducing nature's ability to reproduce twins"), the features of the research itself (splitting embryos that never could become viable and with no plan to implant either the original or the split embryos), and the review procedures surrounding the experiment. Cet article se fonde sur un retour d’expérience auprès d’un nouveau-né présentant une maladie invalidante, lors de ses séjours en service de néonatologie au CHU d’Amiens puis de son hospitalisation à domicile. L’équipe de soins psychiques périnataux accompagne la famille dans le cadre d’une application thérapeutique de l’observation du nourrisson selon la méthode Esther Bick. Initié à l’hôpital et se continuant au domicile, ce travail a porté sur la restauration de la fonction parentale, celle-ci permettant la construction d’une peau psychique (...) relationnelle et le déploiement d’une qualité relationnelle étonnante et particulièrement vivante. The authors of this article are previous or current members of the Clinical Ethics Consultation Affairs (CECA) Committee, a standing committee of the American Society for Bioethics and Humanities (ASBH). The committee is composed of seasoned healthcare ethics consultants (HCECs), and it is charged with developing and disseminating education materials for HCECs and ethics committees. The purpose of this article is to describe the educational research and development processes behind our teaching materials, which culminated in a case studies book called (...) A Case-Based Study Guide for Addressing Patient-Centered Ethical Issues in Health Care (hereafter, the Study Guide). In this article, we also enumerate how the Study Guide could be used in teaching and learning, and we identify areas that are ripe for future work. (shrink)

The prospect of “curing” spinal cord injury using stem cell therapy is one of the significant goals of many stem cell researchers. In this communication we consider some of the physiological implications of successful in vivo spinal cord repair and the ethical issues this potential revolutionary therapy will raise.

As infancy is characterized by rapid physical growth and critical periods of development, disruptions due to illness or disease reveal vulnerability associated with this period. Spinal cord injury has devastating consequences at any age, but its onset neonatally, at birth, or within the first year of life multiplies its impact. The immediate physical and physiological consequences are obvious and immense, but the effects on the typical trajectory of development are profound. Activity-based restorative therapies capitalize on activity-dependent plasticity of the neuromuscular (...) system below the lesion and when provided to children with SCI aim to improve the child’s neuromuscular capacity, health and quality of life. This is a report of an infant with a cervical SCI at birth resulting in paralysis of leg and trunk muscles and paresis of arm and hands who was enrolled in an ABRT program at 3 years of age. After 59 sessions of ABRT, the child demonstrated significant improvements in trunk control and arm function, as well as social and emotional development. Despite the chronicity of injury and low expectations for improvement with therapeutic interventions, ABRT had a positive impact on the child’s physical capacity and provided benefits across multiple developmental domains. Mr. C is a twenty‐two‐year‐old who was flown to a level‐1 trauma center after diving headfirst into shallow water. Prior to this accident, he was in excellent health. At the scene, he had been conscious but was paralyzed and had no sensation below his neck. The emergency medical services team immobilized Mr. C's neck with a cervical collar and intubated him for airway protection before transport. As Mr. C's medical care proceeds, he expresses a desire for extubation, although it was (...) not clear that he had the capacity to make this (or any other) decision. It also was unclear whether this desire reflected his authentic wishes to be allowed to die or stemmed from feelings of discomfort and agitation. Over a period of several days, Mr. C's sedation was lightened, and the psychiatry service conducted a formal decision‐making capacity assessment. Mr. C continues to express a desire to withdraw life‐sustaining medical treatment. However, the psychiatry service is concerned that Mr. C seems to lack adequate insight into what it would mean to die.What does it mean to respect Mr. C's autonomy? (shrink)

Adenosine transport in cultured human umbilical vein endothelial cells (HUVEC) was characterized and shown to be mediated by a single facilitated diffusion mechanism. Initial rates of adenosine influx at 22 degrees C were saturable [apparent Michaelis constant, 69 +/- 10 mu M; maximum velocity (V-max), 600 +/- 70 pmol.10(6) cells(-1).s(-1)] and inhibited by nitrobenzylthioinosine (NBMPR). Formycin B had an unusually high affinity [inhibitory constant K-i), 18 +/- 4.3 mu M], whereas inosine had a low affinity (K-i, 440 +/- 68 mu (...) M) and nucleobases were without effect on adenosine influx. The number of transporters (1.2 x 10(6) sites/cell) was estimated by NBMPR equilibrium binding (apparent dissociation constant, 0.11 +/- 0.01 nM; maximum binding, 2.0 +/- 0.15 pmol/10(6) cells). In addition, we compared these endothelial cells with those obtained from cords from pregnancies complicated by diabetes (HUVEC-D), since embriopathy may occur in these conditions. HUVEC-D exhibited a 2.3-fold reduction in both the V-max for adenosine influx and the maximum number of NBMPR binding sites (260 +/- 40 pmol.10(6) cells(-1).s(-1) and 0.86 +/- 0.08 pmol/10(6) cells, respectively). However, the turnover number for each nucleoside transporter in normal and diabetic HUVEC was similar (approximate to 300 adenosine molecules/s). Adenosine metabolism at 10 mu M in HUVEC-D was modified compared with normal cells. Intracellular phosphorylation (> 90%) was the predominant pathway in normal HUVEC, whereas in HUVEC-D, substantial levels of adenine and adenosine were detected. The present results demonstrate therefore the downregulation of the NBMPR-sensitive nucleoside transporter and changes in adenosine metabolism in HUVEC from diabetic pregnancies. (shrink)

Beauchamp (bio)AbstractThis article is a reply to Robert Baker’s attempt to rebut moral fundamentalism, while grounding international bioethics in a form of contractarianism. Baker is mistaken in several of his interpretations of the alleged moral fundamentalism and findings of the Advisory Committee on Human Radiation Experiments. He also misunderstands moral fundamentalism generally and wrongly categorizes it as morally (...) bankrupt. His negotiated contract model is, in the final analysis, itself a form of the moral fundamentalism he declares bankrupt.Robert baker’s imaginative and incisive articles on international bioethics (Baker 1998a & b) are rich in history and philosophy, but they are as profoundly misguided as they are misdirected. In this comment, I will concentrate both on a pivotal interpretation and criticism that he offers of the Report of the Advisory Committee on Human Radiation Experiments (ACHRE 1996) and on his philosophical thesis that a moral fundamentalism of principles and rights is bankrupt. Baker seriously misinterprets the ACHRE report, distorts and fails to refute moral fundamentalism, and ultimately embraces a form of the very fundamentalism that he declares bankrupt. These three topics are connected in that Baker’s misconceptions of the ACHRE report launch his critique of moral fundamentalism and his mistaken understanding of moral fundamentalism drives his critique of the ACHRE report. 1 [End Page 389]Some Misunderstandings of the Human Radiation CommitteeBaker proclaims a conflict between ACHRE’s moral fundamentalism and multiculturalism. He presents this conflict as primarily a factual issue regarding whether different cultures and eras accept different moral principles—“the difference claim,” in his vernacular (Baker 1998a, pp. 208–9). This interpretation eventuates in a critique of the work of both ACHRE and Ruth Macklin:[W]hen Macklin and the Radiation Committee consider the challenge of multiculturalism, they construe this challenge, not as dispute about anthropological fact, but as a dispute about philosophical theory. More specifically, they treat any assertion of the difference claim as a form of “ethical relativism.”... They thus respond to the multiculturalist’s factual observations—even to factual observations by anthropologists—as if they were philosophical analyses.(Baker 1998a, p. 209)Baker thinks that a factual question has been fallaciously transformed into a philosophical one. However, this false dilemma is a figment of his fancy. He provides no citation to ACHRE to show that it holds this view, and for an understandable reason: This position is neither stated nor presumed in the Report. ACHRE is quite clear that relativism involves both an anthropological (I would prefer to say historical) dispute about fact and a philosophical dispute about value—and that they are not the same.The Committee and its staff proceeded as follows: They first collected a large body of historical documents and facts about the practices, policies, and values that prevailed during the period they were studying. Chapters 1 through 3 and 5 through 13, 12 of the Report’s 18 chapters, display the results of this empirical work. The Committee concluded, on this basis, that research investigators and government officials were aware of the obligations generated by universal principles. The ACHRE report specifically lists six “basic” moral principles and maintains that these principles were pervasively recognized at the time of the radiation experiments (ACHRE 1996, pp. 114ff, 124). ACHRE received testimony, conducted interviews, and compiled documents that indicated how deeply these principles were woven into the fabric of American culture at the time, so deeply that no responsible research investigator could have been unaware of them. ACHRE did not move beyond its list of six principles to a broader thesis about the (factual) universality of other principles and did not examine other cultures or periods of history; such work would [End Page 390] have exceeded ACHRE’s mandate and would have done more to obscure than to further its arguments.ACHRE also found that some government officials had attempted to hide their wrongdoing—a clear indication that these officials were aware of the relevant moral principles and knew that they should not have been treating persons as they did (ACHRE 1996, pp. 152–53; Chapman 1946). Sham surgery is a controversial and rarely used component of randomised clinical trials evaluating surgical interventions. The recent use of sham surgery in trials evaluating efficacy of intracerebral fetal tissue grafts in Parkinson’s disease has highlighted the ethical concerns associated with sham surgery controls. Macklin, and Dekkers and Boer argue vigorously against use of sham surgery controls. Macklin presents a broad argument against sham surgery controls while Dekkers and Boer present a narrower argument that sham surgery is unnecessary (...) in the specific setting of fetal tissue engraftment for Parkinson’s disease. I defend sham surgery controls against both these criticisms. Appropriate clinical trial design, sometimes including sham surgery, is needed to ensure that false positive trial results do not occur and endanger public safety. Results of a completed trial of fetal tissue grafting for Parkinson’s disease are used to illustrate the potential benefits of, and problems associated with, sham surgery controls. Sham surgery controls, however, should be employed only when absolutely necessary. I suggest criteria for appropriate use of sham surgery controls. (shrink)

After spinal cord injury (SCI), motoneuron death occurs at and around the level of injury which induces changes in function and organization throughout the nervous system, including cortical changes. Muscle affected by SCI may consist of both innervated (accessible to voluntary drive) and denervated (inaccessible to voluntary drive) muscle fibers. Voluntary activation measured with transcranial magnetic stimulation (VATMS) can quantify voluntary cortical/subcortical drive to muscle but is limited by technical challenges including suboptimal stimulation of target muscle relative to its antagonist. (...) The motor evoked potential (MEP) in the biceps compared to the triceps (i.e., MEP ratio) may be a key parameter in the measurement of biceps VATMS after SCI. We used paired pulse TMS, which can inhibit or facilitate MEPs, to determine whether the MEP ratio affects VATMS in individuals with tetraplegia. Ten individuals with tetraplegia following cervical SCI and ten non-impaired individuals completed single pulse and paired pulse VATMS protocols. Paired pulse stimulation was delivered at 1.5, 10, and 30 ms inter-stimulus intervals (ISI). In both the SCI and non-impaired groups, the main effect of the stimulation pulse (paired pulse compared to single pulse) on VATMS was not significant in the linear mixed-effects models. In both groups for the stimulation parameters we tested, the MEP ratio was not modulated across all effort levels and did not affect VATMS. Linearity of the voluntary moment and superimposed twitch moment relation was lower in SCI participants compared to non-impaired. Poor linearity in the SCI group limits interpretation of VATMS. Future work is needed to address methodological issues that limit clinical application of VATMS. (shrink)

Although activated spinal cord glia contribute importantly to neuropathic pain, how nerve injury activates glia remains controversial. It has recently been proposed, on the basis of genetic approaches, that toll-like receptor 4 may be a key receptor for initiating microglial activation following L5 spinal nerve injury. The present studies extend this idea pharmacologically by showing that TLR4 is key for maintaining neuropathic pain following sciatic nerve chronic constriction injury. Established neuropathic pain was reversed by intrathecally delivered TLR4 receptor antagonists derived (...) from lipopolysaccharide. Additionally, -naltrexone, -naloxone, and -naloxone, which we show here to be TLR4 antagonists in vitro on both stably transfected HEK293-TLR4 and microglial cell lines, suppressed neuropathic pain with complete reversal upon chronic infusion. Immunohistochemical analyses of spinal cords following chronic infusion revealed suppression of CCI-induced microglial activation by -naloxone and -naloxone, paralleling reversal of neuropathic pain. Together, these CCI data support the conclusion that neuron-to-glia signaling through TLR4 is important not only for initiating neuropathic pain, as suggested previously, but also for maintaining established neuropathic pain. Furthermore, these studies suggest that the novel TLR4 antagonists -naloxone and -naloxone can each fully reverse established neuropathic pain upon multi-day administration. This finding with -naloxone is of potential clinical relevance. This is because -naloxone is an antagonist that is inactive at the -opioid selective receptors on neurons that produce analgesia. Thus, these data suggest that -opioid antagonists such as -naloxone may be useful clinically to suppress glial activation, yet -opioid agonists suppress pain. (shrink)

What is the relationship between our perceptions and reality? What is the relationship between the mind and the body? These are questions with which philosophers have grappled for centuries, and they are topics of considerable contemporary debate as well. Hilary Putnam has approached the divisions between perception and reality and between mind and body with great creativity throughout his career. Now, in _The Threefold Cord: Mind, Body, and World,_ he expounds upon these issues, elucidating both the strengths and weaknesses of (...) current schools of thought. With his characteristic wit and acuity, Putnam offers refreshing solutions to some of philosophy's most vexing problems. Putnam first examines the problem of realism: is objective truth possible? He acknowledges the deep impasse between empirical and idealist approaches to this question, critiquing them both, however, by highlighting the false assumption they share, that we cannot perceive the world directly. Drawing on the work of J. L. Austin and William James, Putnam develops a subtle and creative alternative, which he calls "natural realism." The second part of the book explores the mind-body question: is the mind independent of our interactions with the physical world? Again, Putnam critically assesses two sharply antithetical contemporary approaches and finds them both lacking. _The Threefold Cord_ shows the entire mind-body debate to be miscast and draws on the later work of Wittgenstein, once more advancing original views on perception and thought and their relationship with both the body and the external world. Finally, Putnam takes up two related problems--the role of causality in human behavior and whether or not thoughts and sensations have an "existence" all their own. The establishment of a functional vascular system requires multiple complex steps throughout embryogenesis, from endothelial cell (EC) specification to vascular patterning into venous and arterial hierarchies. Following the initial assembly of ECs into a network of cord‐like structures, vascular expansion and remodeling occur rapidly through morphogenetic events including vessel sprouting, fusion, and pruning. In addition, vascular morphogenesis encompasses the process of lumen formation, critical for the transformation of cords into perfusable vascular tubes. Studies in mouse, zebrafish, frog, and human endothelial (...) cells have begun to outline the cellular and molecular requirements underlying lumen formation. Although the lumen can be generated through diverse mechanisms, the coordinated participation of multiple conserved molecules including transcription factors, small GTPases, and adhesion and polarity proteins remains a fundamental principle, leading us closer to a more thorough understanding of this complex event. The Hoffmann reflex (H-wave) is produced by alpha-motoneuron activation in the spinal cord. A feature of this electromyography response is that it exhibits fluctuations in amplitude even during repetitive stimulation with the same intensity of current. We herein explore the hypothesis that physical training induces plastic changes in the motor system. Such changes are evaluated with the fractal dimension (FD) analysis of the H-wave amplitude-fluctuations (H-wave FD) and the cross-covariance (CCV) between the bilateral H-wave amplitudes. The aim of this study (...) was to compare the H-wave FD as well as the CCV before and after track training in sedentary individuals and athletes. The training modality in all subjects consisted of running three times per week (for 13 weeks) in a concrete road of 5 km. Given the different physical condition of sedentary vs. athletes, the running time between sedentary and athletes was different. After training, the FD was significantly increased in sedentary individuals but significantly reduced in athletes, although there were no changes in spinal excitability in either group of subjects. Moreover, the CCV between bilateral H-waves exhibited a significant increase in athletes but not in sedentary individuals. These differential changes in the FD and CCV indicate that the plastic changes in the complexity of the H-wave amplitude fluctuations as well as the synaptic inputs to the Ia-motoneuron systems of both legs were correlated to the previous fitness history of the subjects. Furthermore, these findings demonstrate that the FD and CCV can be employed as indexes to study plastic changes in the human motor system. (shrink)

L'éternalisme, la thèse selon laquelle les entités que nous catégorisons comme étant passées, présentes et futures existent tout autant, est la meilleure approche ontologique de l'existence temporelle qui soit en accord avec les théories de la relativité restreinte et de la relativité générale. Cependant, les théories de la relativité restreinte et générale ne sont pas fondamentales si bien que plusieurs programmes de recherche tentent de trouver une théorie plus fondamentale de la gravité quantique rassemblant tous les enseignements de la physique (...) relativiste et de la physique quantique. Certaines de ces approches soutiennent que le temps n'est pas fondamental. Toutefois, si le temps n'est pas fondamental, quelles en sont les conséquences pour l'éternalisme et les débats sur l'existence dans le temps ? Premièrement, je soutiendrai que la non-fondamentalité du temps que l'on rencontre dans la théorie des cordes mène à l'éternalisme standard. Deuxièmement, je soutiendrai que la non-fondamentalité du temps rencontrée dans la gravité quantique à boucles implique l'éternalisme atemporel, à savoir une nouvelle position qui demeure fidèle à l'esprit de l'éternalisme standard. Pourquoi Ludwig Wittgenstein était-il fasciné par certaines œuvres du grand écrivain suisse Gottfried Keller? Cette question a intrigué Jacques Bouveresse et le fruit de cette interrogation a donné son ouvrage Le danseur et sa corde, Wittgenstein, Tolstoï, Nietzsche, Gottfried Keller et les difficultés de la foi (Marseille, Agone, 2014). Dans l’échange qui suit, organisé en mai 2017 par la section genevoise de la Société suisse de philosophie, Jacques Bouveresse et Ruedi Imbach se penchent sur le titre de cet ouvrage, sur (...) l’intention qui a présidé à sa rédaction, mais aussi sur la critique aiguë du christianisme institutionnel, surtout dans sa version doctrinale et doctrinaire, dans certaines œuvres de Keller, ainsi que sur le fort intérêt de Wittgenstein pour ces œuvres et pour cette critique. Les deux auteurs s’accordent pour dire que le christianisme ne s’enseigne pas : il est plutôt quelque chose qui relève de la vie. (shrink)

Nous sommes des êtres à la fois spirituels et corporels. Mon poids est un attribut corporel, tandis que ma capacité d'imaginer un paysage marin relève d'un attribut mental. Or, une fois admise cette dualité des attributs, comment concevoir l'interaction entre le corps et l'esprit? Face aux doctrines dualistes qui échouent à répondre à cette question, Max Kistler défend ici une variante du matérialisme réductionniste qui fait droit à la notion d'émergence : corps et esprit se logent au sein d'une hiérarchie (...) de niveaux de réalité. Les personnes - exclusivement composées, comme tout autre objet matériel, d'atomes - ont des propriétés émergentes que ne possède aucune de leurs composantes. L'auteur développe ainsi une nouvelle conception de l'émergence qui la rend compatible avec la réduction. Une personne peut penser tandis qu'aucune partie de son corps ne le peut : en ce sens, la capacité de penser émerge au niveau de la personne. Mais il est en principe possible d'expliquer cette capacité en termes des parties physiologiques de la personne. La physique contemporaine pourrait bien nous livrer un enseignement incroyable, à savoir que l'espace et le temps n'existent pas fondamentalement. Je présenterai succinctement les ontologies suggérées par les deux principaux programmes de recherche en gravité quantique : la théorie des cordes et la gravité quantique à boucles. Je soutiendrai ensuite qu'il est fructueux de prendre les différentes conceptions ontologiques de la conscience en philosophie de l'esprit en modèles pour la construction de solutions au problème de l'émergence de l'espace-temps.

Parmi les déesses du monde mésopotamien, deux figures féminines se dégagent : les soeurs Ištar et Ereškigal. Ištar agit dans la sphère des relations amoureuses, et surtout de la bataille. Elle joue dans la guerre comme elle le ferait « avec une corde à sauter ». Ereškigal règne sur le monde des morts : elle est celle « qui n’a pas connu le jeu des jeunes filles ». Cette contribution s’appuie sur les documents écrits (hymnes, narrations mythologiques) en cunéiformes (sumérien (...) – akkadien et textes bilingues) des iie et ier millénaire av. n. è. Elle prend pour angle d’approche les relations conflictuelles entre ces grandes déesses pour mieux saisir leurs rapports respectifs au jeu : où et quand jouent-elles? À quoi et avec qui jouent-elles? Quelles sont les informations que l’on peut en tirer pour les femmes et jeunes filles humaines? Diverses problématiques sont abordées à la lumière des études de genre : celles des rapports intergénérationnels et interfamiliaux, de la définition des espaces privé-public, de la séduction et de l’érotisme. Le dieu musicien l’emporte parce qu’il joue de sa cithare après l’avoir retournée, exécutant une manœuvre que son rival est incapable de reproduire avec l’aulos. Apollon fait ainsi de sa cithare un instrument palintone et palintrope, très proche de son arc réflexe, un instrument capable d’inverser sa position, mais aussi de renverser la situation au profit de celui qui l’utilise. Même « conduite de retournement (...) » pour la lyre, dont la réversibilité efficace est redevable à la tortue ainsi qu’à Hermès et à son travail de luthier. La puissance de retournement des instruments à cordes apolliniens permet de jeter un éclairage nouveau sur la victoire d’Apollon et sur l’écorchement de Marsyas, tout en situant l’épisode dans le champ de la mètis. De l’instrument d’Apollon, retourné vers le bas, qui précipite Marsyas aux Enfers, à celui d’Orphée, tenu à l’endroit, qui en ramène Eurydice, se dessine la nature ambivalente de la lyre symétrique à celle de l’arc. Comme lui, la lyre est bien « signe de chute », de la vie vers la mort, ou « signe de remontée », de la mort vers la vie.The reversal’s notion and the musical agôn between Apollon and Marsyas in ps.-Apollodorus: interpretation of a myth. Thus, Apollo turned his kithara into a palintonos and palintropos instrument, very much like his reflex bow, an instrument, whose position could be reversed but which could also reverse the situation to the benefit of its user. The same reversal ability is true of the lyre, which could be played efficiently both ways thanks to the tortoise and to Hermes, the skilful lyremaker. The extraordinary capacity of Apollinian stringed instruments to be reversed throws a new light on both Apollo’s victory and Marsyas’s skinning, setting the episode in the mètis area. From Apollo’s reversed lyre hurling Marsyas down into Hades to Orpheus’s being played the right way, to bring back Euridyke from the underworld, emerges the ambivalent nature of the lyre in perfect symmetry with the bow’s. Cet article explore les soubassements socioculturels liés à l’émergence de cette industrie et tente d’élucider les enjeux éthiques et politiques qu’elle pose. Si les banques publiques de sang de cordon sont porteuses (...) des valeurs d’altruisme et de solidarité nationale traditionnellement liées au modèle redistributif d’échange de sang et d’organes né après la Seconde Guerre mondiale, les banques privées renvoient, elles, à des formes de solidarité bien différentes. C’est effectivement sous couvert de la solidarité familiale et de la responsabilité morale des mères de protéger leurs enfants qu’elles définissent la conservation privée comme une forme d’ « assurance biologique » contre les risques à la santé de l’enfant. En permettant aux mères d’investir leurs tissus corporels à la fois dans le futur incertain de leurs enfants et dans des thérapies cellulaires expérimentales, ces banques promeuvent un nouveau modèle de participation du/de la patient.e à la coconstitution de futures innovations thérapeutiques. Nous inscrivons ce modèle de participation dans les reconfigurations contemporaines du biopolitique que le sociologue britannique Nikolas Rose voit s’incarner dans l’émergence d’une nouvelle forme de biocitoyenneté. This article explores the sociocultural context surrounding the emergence of this industry and aims at elucidating the ethical and political concerns that this industry raises. Whereas public cord blood banks are purveyors of values such as altruism and national solidarity traditionally linked to the redistributive model of human blood and organ donation that emerged after World War Two, private banks engage very different forms of solidarity. It is indeed under the guise of family solidarity and mothers’ moral responsibility to do their best to protect their children that they come to define private preservation as a form of “biological insurance” against potential risks to their children’s health. By allowing mothers to invest their bodily tissues simultaneously in their children’s uncertain future and in experimental cell therapies, these banks promote a new model of patient participation in the development of future therapeutic innovations. This article analyzes this model as embedded in the contemporary reconfiguration of biopolitics that sociologist Nikolas Rose envisions as constituting a new form of biocitizenship. The paper finally casts a critical eye on these personalized services, in particular because of the new forms of social coercion on mothers that are brought about in a social and political context characterized by an increasing moral accountability of individuals with regard to the “good management” of their own health risks. Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. This research is founded on the fundamental hypothesis that a holistic perspective and general understanding play a decisive role in shaping the terminology of any discipline and organizing its components and subfields within a coherent methodological framework. Possessing such a holistic perspective and understanding is a key factor in determining the creativity, innovative approaches, and depth of expertise of scholars, as well as their ability to guide the discipline in accurate and constructive directions. The study explores this hypothesis in the (...) context of Hadith sciences, specifically focusing on Hadith criticism and the evidentiary value of narrations. It de-monstrates that Hadith scholars adopted a holistic view by considering the impact of thematic chapters (bab) in their criticism of Hadiths and their judgments regarding authenticity or rejection. This approach is evident in the classification of Hadith compilations, where Hadiths are arranged ac-cording to thematic chapters. Subsequently, each narration, Hadith, or chain of transmission (isnād) is evaluated in light of the established princip-les and evidence specific to these chapters, including other supporting pro-ofs. Over time, these principles and evidences became well-defined within each chapter, serving as essential criteria for assessing subsequent narrati-ons and scholarly interpretations.The research is structured around five main axes:1.The concept of thematic babs and their relationship with Hadith, inc-luding an analysis of their historical application by muhaddithūn in classifi-cation and methodological development.2.The impact of singularity (tafarrud) within Hadith chapters and the criteria for its acceptance or rejection.3.The relationship between solitary (āhād) Hadiths and singularity, and the significance of thematic categorization in this context.4.The role of thematic babs in evaluating discrepancies among narra-tors (rāwīs) and determining preferences.5.The influence of thematic babs on judging Hadiths as munkar or unacceptable.The study concludes by affirming the strong and intrinsic connection between the thematic categorization of Hadiths and Hadith criticism, emp-hasizing that this relationship constitutes a fundamental element in the judgments of critics regarding Hadiths. Additionally, it confirms the impact of thematic classification on the evaluation of narrators and the grading of Hadiths.The research highlights that neglecting the thematic context of Hadiths when examining narrators and their narrations has led later scholars (mu-ta’akhkhirūn) to methodological errors, diverging from the approaches of master Hadith critics and well-established jurists. Therefore, particular at-tention must be given to the meticulous classification employed by Hadith scholars, especially the authors of the Kutub al-Sittah, whose precision in categorization reflects a profound understanding of Hadiths and their cor-rect interpretation. Finally, the study underscores that the pinnacle of matu-rity and excellence in Hadith classification is particularly evident in the ar-rangement of authentic compilations, with Imam al-Bukhārī (d. 256/870) standing as a leading figure. His methodological rigor in the organization of the Sahīh and the profound insights derived from his use of chapter hea-dings (bab titles) exemplify an unparalleled model in this domain. (shrink)
